1. Who Processes Your Personal Data

We have not appointed a Data Protection Officer (DPO), as this is not required under the GDPR. If you have any questions regarding the processing of personal data, you can contact us using the contact details above.
2. What Personal Data We Process
Depending on how you communicate with us, we may in particular process the following categories of data:
a) Employers / corporate clients
- first name and surname of the contact person
- position / job title
- company name, company ID number (IČO)
- e-mail, phone number
- information about the positions sought (e.g. drivers, welders, other professions)
- data entered in the enquiry form (number of workers, required routes, starting date, etc.)
b) Candidates / job applicants
- first name and surname
- e-mail, phone / WhatsApp
- nationality
- desired job position
- work experience and education
- data contained in your CV and cover letter
c) Agency partners
- name of the agency
- contact person
- e-mail, phone number
- information about the proposed cooperation
We obtain your data in particular from:
- directly from you via contact and registration forms on our website,
- from e-mail communication and telephone calls,
- from attachments that you voluntarily provide to us (e.g. CV).
3. For What Purposes and on What Legal Basis We Process Data
3.1 Recruitment and job / staff placement
- assessment of your enquiry as an employer,
- searching for suitable candidates for your company,
- assessment of candidates and mediation of job offers,
- organising interviews and work trials.
Legal basis:
- performance of a contract or pre-contractual relations (Art. 6(1)(b) GDPR),
- legitimate interests of the controller and clients (Art. 6(1)(f) GDPR).
3.2 Communication and responding to enquiries
- responding to completed forms (e.g. “Quick enquiry”, forms for employers, candidates and agencies),
- ordinary business communication.
Legal basis:
- performance of a contract / pre-contractual relationship,
- legitimate interest (efficient communication).
3.3 Compliance with legal obligations
- obligations arising from labour law regulations, the Accounting Act, tax regulations, etc.
Legal basis:
- compliance with legal obligations (Art. 6(1)(c) GDPR).
3.4 Marketing communication (only with consent)
- sending information about job vacancies,
- sending offers of our services and news in the field of HR and recruitment,
- contacting you via e-mail or phone / WhatsApp if you have given us your consent in the relevant checkbox in the form.
Legal basis:
- your consent (Art. 6(1)(a) GDPR).
You may withdraw your consent at any time, for example by replying to an e-mail or by contacting us at info@ergasia.group.
4. To Whom Data May Be Disclosed
We may disclose your personal data to:
- our corporate clients (employers) for whom we are seeking workers,
- candidates to whom we present a job offer,
- our contractual partners – processors who assist us with technical and organisational support:
- providers of CRM and project management tools (e.g. ClickUp),
- providers of integration and automation services (e.g. Make.com),
- providers of hosting, e-mail and IT services.
We have concluded data processing agreements with all processors, and they are obliged to protect your data at least to the same extent as we do.
5. Transfer of Data to Third Countries
Some of our processors may be established outside the EU/EEA (for example providers of cloud services). In such cases, we ensure data protection in accordance with the GDPR, in particular through:
- Standard Contractual Clauses,
- or other appropriate safeguards pursuant to Art. 46 GDPR.
We will be happy to provide you with more detailed information on transfers to third countries upon request.
6. How Long We Retain Data
- enquiries from employers and agencies: generally 2 years from the last active communication, if we do not conclude a contract and no longer statutory retention period arises,
- candidate data / CVs: generally 2 years from submission, or shorter if you request erasure or withdraw your consent,
- accounting and tax documents: generally 10 years as required by law.
After the expiry of the retention period, we either securely delete the data or anonymise it.
7. What Rights You Have
As a data subject, you have in particular the following rights:
- the right of access to personal data,
- the right to rectification of incorrect or outdated data,
- the right to erasure (“right to be forgotten”) in the cases laid down by the GDPR,
- the right to restriction of processing,
- the right to object to processing based on legitimate interest,
- the right to data portability (where processing is based on consent or a contract),
- the right to withdraw consent at any time where the legal basis for processing is your consent,
- the right to lodge a complaint with a supervisory authority.
